How would you estimate that a person who applies for the position is ethical? Also if is a member or operates on the same level it draws a lots of questions how that affects the community.
I agree on everything you said, but there should be a very clear limit what moderator can do and in my opinion the best possible option for community-staff relation is if only an administrator keeps the right to address his 'little community' and moderators should work behind the scenes protecting the community.

What you say does make sense but I think we can only see how things go after the mod starts working. We should also have a say incase we aren't happy with his way of conduct.
